1. Acceptance
By creating an account or using tessolo (the “Service”) you agree to these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” refers to both you and that organization. If you do not agree to these Terms, do not use the Service.
2. The Service
The Service is an AI-assisted platform for designing, hosting, and publishing marketing landing pages. Features evolve over time; we may add, modify, or remove functionality, and we may make some features available only on paid plans.
3. Your account
- You are responsible for the accuracy of the information you provide.
- You are responsible for safeguarding your credentials and for all activity that occurs under your account.
- You must promptly notify us at legal@tessolo.com if you suspect unauthorized use of your account.
4. Acceptable use
You agree not to use the Service to create, host, or distribute content that:
- is illegal under any law that applies to you, us, or the visitor;
- impersonates a person or brand for fraudulent purposes, including phishing pages and scam funnels;
- distributes malware, exploits, or other harmful code;
- harvests email addresses or other personal data for unsolicited bulk messaging;
- sexually exploits children or depicts child sexual abuse material;
- harasses, threatens, or incites violence against an individual or group;
- infringes a third party’s intellectual-property or privacy rights.
We may investigate suspected violations and may suspend or terminate access to the Service, remove offending content, and report unlawful activity to the relevant authorities. We are under no obligation to monitor content but reserve the right to act on violations we discover.
5. Your content
You retain ownership of the content you upload or create using the Service (“Your Content”). To operate the Service, you grant Tessolo a worldwide, non-exclusive, royalty-free license to host, cache, transmit, display, and create technical copies of Your Content solely for the purpose of providing and improving the Service to you and your visitors. You warrant that you have all rights necessary to grant this license.
6. Our intellectual property
The Service, including its software, user interface, page-block templates, AI prompts, and brand assets, is the intellectual property of Tessolo or our licensors. These Terms do not grant you any right in our intellectual property except the limited right to use the Service as described.
7. Billing and subscriptions
Plans, prices, and usage allowances are described on the pricing page. Paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. Taxes, where applicable, are your responsibility. Refunds are at our discretion and follow the policy listed on the pricing page or in your invoice. Stripe, our payment processor, may have separate terms that also apply.
8. Termination
You may close your account at any time from your workspace settings. We may suspend or terminate your access if you materially breach these Terms, if your use creates a security or compliance risk, or if we are required to do so by law. On termination, your right to use the Service ends; sections that by their nature survive termination (including content licenses for material we are required to retain, disclaimers, and limitations of liability) continue to apply.
9. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that AI outputs will be accurate, or that any specific business outcome will result from using the Service.
10. Limitation of liability
To the maximum extent permitted by law, Tessolo’s aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the fees you paid us in the twelve months immediately before the event giving rise to the claim, and (b) USD 100. In no event will we be liable for indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost data, or lost goodwill, even if advised of the possibility of such damages.
11. Indemnification
You will defend, indemnify, and hold Tessolo harmless from and against any third-party claims, losses, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service in violation of these Terms, or your violation of applicable law.
12. Governing law and disputes
These Terms are governed by the laws of the operator's jurisdiction, without regard to its conflict-of-laws rules. Before filing a formal claim, you agree to attempt to resolve any dispute informally by contacting us at legal@tessolo.com and giving us 60 days to respond. If we cannot resolve the dispute informally, it will be submitted to the courts of the operator’s jurisdiction, and you consent to the personal jurisdiction of those courts.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we update the “Last updated” date and, for material changes, notify you in-app or by email before they take effect. Your continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.
